Applying for your License Following a Ban

If you have been disqualified from driving for a number of years, it may be possible for you to apply for your license back early rather than waiting for the end of the ban.

This would not be an appeal against the ban. Specialist driving solicitors can advise you of the merits of your application and make the application on for you. The application for the early reinstatement of your driving license must be made to the court that imposed the original ban. When the application is heard, we can advise you on the criteria that the court will look at and represent you throughout the application process:

 

Specialist driving solicitors will advise you that the court will look into and consider your “character”, both at the time of the commission of the original offence (which led to the ban) and your character post-conviction;

 

The court will look at the nature of the original offence for which you were convicted;

 

Any other circumstances of the case.

Specialist road traffic solicitors will advise you on the merits of making an application to ensure that you do not waste your money on an application if it is doesn’t have the legs to succeed. In the first instance, we would need to establish whether you are entitled to make an application for early return of your driving license:

An application may only be made if:

Where you were disqualified for 4 years or less, at least 2 years must have passed since you were disqualified; 

 

Where you were disqualified for 4-10 years, then you can only make the application for early return of your license once half of the period of disqualification has passed;

 

Where you were disqualified for 10 years or more, you can only make the application for early return of your license once 5 years of the period of disqualification has passed.

If your application is refused, it is possible to make a fresh application after three months from the date of refusal.
